The Chix Files: Test In Election Petitions


The jurisprudence on election petitions make it clear that where there has been substantial non compliance with constitutional provisions and the law, which substantial non compliance affected the outcome of the elections, the results would be overturned. The Petitioners therefore have to show that the Electoral Commission did not comply with the law and that the Electoral Commission’s non compliance was substantial and further that the Electoral Commission’s substantial non compliance with the law affected the outcome of the 2012 elections.

The law for the 2012 Elections inter alia required biometric verification prior to voting and that presiding officers must sign the pink sheets. The Petitioners allege that the Electoral Commission did not comply with the requirement of biometric verification prior to voting thereby allowing 743,415 votes to be added to the total valid votes, which votes are invalid and ought to have been disregarded in the final tally. The Petitioners also allege that the Electoral Commission did not comply with the requirement that all pink sheets must be signed by the presiding officer and thereby allowed 751,528 votes to be added to the total valid votes, which votes were invalid and ought to have also been disregarded in the final tally.

The Petitioners must also demonstrate that the addition of these invalid votes, amongst others, substantially affected the outcome of the 2012 presidential elections. According to the Petitioners, the non compliance with the law by the Electoral Commission was substantial and affected the outcome of the 2012 elections in that if the alleged irregularities are removed, the 1st Petitioner ought to have been declared President of Ghana with 59.69% of the valid votes cast.

That in my opinion satisfies the test in election petitions, subject to evidentiary proof.

Members of the media, invited guests we are grateful to see you all here covering this event. I consider it a great honour and a privilege to be addressing this press conference. I come to this press event today first as a citizen of this country and secondly as one deeply interested in our democratic growth as a people.  The very fact that I have an opportunity to be addressing the media today, unknown to national politics but nonetheless a concerned citizen should speak volumes for our democratic growth. I, not unlike others have spent the last several years observing and contributing in varied ways from afar the course and growth of our democracy. In the last few months I have had the opportunity to be here at home in Ghana to participate in the 2012 elections and now like many of you a concerned citizen keenly interested in the unfolding story of what really transpired in the  2012 elections. With all the focus on the Supreme Court and the discussions and debates (not to mention the spin machines at optimal speed), it is not uncommon to lose sight of the commendable work done in the area of ensuring peace and protecting our democracy by some of the key players in this test of our electoral process and to a great extent the ‘fibre’ test of our constitution. I’m in full agreement with a statement that says a time comes ‘when silence is betrayal…’ For me that time has come in relation to the issue  of electoral irregularities (as a backdrop in the 2012 presidential elections) and my knowledge of Nana Akufo- Addo‘s record on  peaceful and democratic means in resolving conflict. Election Petition: Nana Addo and Co. file better and further particulars


Lawyers for Nana Addo and the two other petitioners contesting the 2012 general elections on Tuesday filed documents providing the Electoral Commission (EC) and President John Mahama with ‘further and better particulars’ regarding their petition before the Supreme Court.

The EC and President Mahama moved separate applications for ‘further and better particulars’ to get the court to order the petitioners to furnish them with the names and codes of the 4,709 polling stations where they (petitioners) claim there were irregularities, while the petitioners also moved their application to get the EC to supply them with the list of voters registered abroad.

In a unanimous decision, the Supreme Court on Tuesday last week ordered Nana Addo’s lawyers to make this information available.

The petitioners were expected to provide particulars for the polling stations where they alleged the EC permitted voting to take place without biometric verification devices.

The court further ordered the petitioners to provide particulars of places where they alleged over-voting took place and places where similar serial numbers on pink sheets had different results.

The Chix Files: Canes For What?


As I drove to work this morning, I thought about the topic of today’s blog. Of course, the first and most obvious thing that came to mind was “blog about what happens at the Supreme Court today”. Great idea but I realised my blog was becoming an update for Nana Akufo-Addo’s Petition at the Supreme Court. Ah well.

So as I drove, I went past a school and I saw children with brooms sweeping the compound before assembly and then class. There wasn’t a child in sight without a broom, duster or dustbin. Then I thought to myself ah, I will blog about this especially because every Ghanaian in their formative years undergoes some discipline in sanitation but somewhere along the line we become filthy.

And then I ended up at the airport to catch my flight to Kumasi and just before I went on board the plane, I decided to use the bathroom and pay some water bills. I entered the male bathroom and to my surprise, for the first time in Ghana, a public bathroom was neat. I thought to myself, this is worth blogging about. I will title my blog today “Neat Toilets”. PRESS CONFERENCE ORGANISED BY THE NEW PATRIOTIC PARTY IN THE AFTERMATH OF THE PRESIDENTIAL DEBATE

Ladies and Gentlemen of the press, thank you for coming to this afternoon’s press conference in such strong numbers and at such short notice.

Our mission here is quite simple. We have now completed a full month of our debate season, having had 2 Presidential debates and one Vice Presidential debate. We would also like to take this opportunity to review what we have learned over the course of the 3 debates and the choice facing Ghana.

Ghanaians have been presented with the various options and the standout choice in each of the debates was clear. In every thematic area, from the economy, to healthcare,  education, good governance, corruption, women, gender and children issues Nana Addo Dankwa Akufo-Addo and Dr Bawumia displayed enormous competence and were the standout choices in all 3 debates.
